Deliberative session is over, and a overwhelming I's took the session by a nearly unanimous vote. All warrant articles will be in the voters hands on Sept 9th starting at 7am. And unlike last years "watered" down warrant articles, this years will be the way they are intended to be.
Attempts were made by some to destroy proposed articles, Paul Dimaggio in particular, but was unable to budge anyone in the room. Even our infamous ex-selectman Jack Sapia showed up and lectured everyone in Atkinson that they are "breaking the Law" and "wasting money". I am sorry Jack, but we are not wasting money on an issue that is very important to all citizens of Atkinson. Congrats to all who showed up and supported these very important warrant articles. See everyone on the 9th of Sept.

Sapia was absolutely correct in what he said in the clip. I would have said the same thing if I lived in your town. Well, back to my own 'fun' issues in Danville.
Well i can tell you this, I do know that the selectman have advised the residents that there will be a potental lawsuit with this issue. Most residents are aware of the fact, and want to continue this fully. This cost is worth every penny for what is up for stake in our town of Atkinson. Mr Sapia, killed the last warrant article last year when he was chairman, even thou the people of Atkinson directed him to do differntly. And he still continues his selfcenterd attitude of whatever horse he thinks he rides on, in my opinion.

More than once I have suggested that you guys/gals read "Knowing the Territory", which explains how municipal government works in NH. You can discount what Sapia said in the clip because you don't like him. You can discount what I say because I don't live in your town. You can discount what your town attorney says because I don't know why. But these ordinances will not protect your water because they are not authorized by state law and therefore they are not enforceable.
There are few ways that the voters of a town can "direct" the selectmen to do anything. The selectmen and all other town officials took an oath to uphold state law, there is no mention of town law. The oath covers town law only to the extent that it is authorized by state law. The selectmen have only those powers authorized by state law.
If the HAWC gets its permit under RSA 485-C:21, and if the selectmen tried to obstruct them under color of your unauthorized local ordinance, they would be in clear violation of their oaths to uphold state laws. They have no legal or ethical choice other than to ignore the ordinance. It is so black and white, there is no wiggle room. No knowledgeable person would say that there is any chance that these ordinances would be upheld in court.
End of rant. Have a nice rest of summer. Maybe I should find some sort of web filter that blocks everything that has the word "Atkinson" in it. :-)
thanks for the info Curt, but you have to understand that the residents feel so very strongly about this issue they are willing to go as far as possible to win . And let me ask you this, If you were told that you had no chance of climbing Mt.Washington, would you try to do it or just quit? I feel that alot of Atkinson residents have already started up the mountain.......

Now how can I get my percentage of the profits from HAWC of the selling of the water under my OWN property that impacts the quality of my well? A Priori...The State of NH is not going to protect the citizens fully, the citizens must protect themselves by acute awareness. Citizens must wake up and smell the greed. If they do then they can vote out selectmen and change planning boards who do not act to protect them. The people can silence the selectmen who are in lock step with this attempt of thievery and establishment of a town utility. It is a failure on the part of the education of the citizens, and notification of citizens of Atkinson that must be addressed. This Blog is doing a tremendous job in raising awareness and enhancing notification. And we all need to do more. I, personally, need to do much more SO LOOK OUT! And my intent is to drive as much evil out of Atkinson town government as possible. It is a good thing you are not in Atkinson, Springer, and I so hope the citizens of Danville wake up and take you on and issue you some "attitude adjustment" as to the protection of the basic rights of citizens to protect their water availability versus greed based NH state tactics. If the people are strong enough, they can retake the entire State of NH government away from those hacks just as the people can take their local town government away from the local entrenched hacks. Mr. Springer, are you getting the message that a REVOLUTION is brewing?
Another thing that wasn't clearly pointed out from our planning board members at the meeting was that the water withdrawl is just for Atkinson Residents according to them. But if you look at the bigger picture, once the Water world gets into more withdrawls from Atkinson, other towns might and most likely will get hooked up to their system, and then you are looking at a really bad situation for Atkinsons aquifer being sucked up to go to other towns. Another thing also is in a year with hardly any rain, and this could be a terrible situation for many residents with wells.

I don't think your mt. washington analogy is apt. That would be a personal effort and wouldn't involve doing anything contrary to law. If you want an analogy involving Mount Washington, try this:
You and your spouse invite a neighbor and spouse and kids to ride up the Mt. Washington auto road with you and your kids.
You arrive and find that the auto road is closed for the year. There is a locked gate across the road with "closed" and "no trespassing" signs. Your neighbor is a locksmith, so you tell him he should pick the lock and open the gate so you can drive up to the summit. Your neighbor tells you he thinks he shouldn't do it because it would be illegal, trespassing or perhaps a more serious crime. You tell him that if he were arrested, nothing would be final until he was convicted, and that you would pay any and all legal expenses. Your neighbor still refuses, stating that he thinks it would be illegal and that he does not want to break the law. You tell him that he has a bad attitude, and that nothing is more important than driving to the top of the mountain, and that it is incredibly self-centered of him to worry about his legal position in light of the importance of this goal.

You really don't get it. It's nothing to do with my "attitude". I'm telling you how things work in the state of NH. Personalities have nothing to do with it. People posting anonymously on blogs are not going to start any kind of REVOLUTION.
I'm not saying that you folks shouldn't be worried or involved in your water situation. But spend your time and money effectively. Hire a hydrologist to analyze HAWC's submissions to the state. Hire a lawyer to explain your options for intervention with their latest proposals to the PUC re rates and franchise area. But don't waste your resources on stuff that will literally be laughed out of court. Sorry I am trying to keep out of your business but a-f did ask for a follow-up.
1. We have already passed an ordinance banning out of town sale. Last year the new ordinance is to strengthen it.
2. The public hearing for DES/HAWC was not legal as the application CLEARLY was not in conformance with the law And DES did not care and rationalized the defect.

4. Contact the consumer advocates office, make sure he has ALL the facts and if you are a effected person intervene yourself, it is a friendly process.
5. Remember how Jack Holbrook changed the government in Atkinson in about 6 months. You may not like the force necessary but the health and property values facts carry enormous influence.

Well all of you have a nice summer and fall, I actually do have a lot of Danville stuff to attend to. BTW I would like to commend the proprietors of the 3 current Atkinson sites for not censoring and for not deleting previously approved posts. I only offered my analysis of the law because I thought some people might appreciate a different POV, from somebody who has no stake in the issue at hand.
Let's get back to Jack for a moment.
When he started talking he mentioned he was taking time from watching his son's championship game to address this important issue, before Frank shut him up.
Jack, what championship game? It was late in the evening, in the middle of summer. What championship game could be going on at that time?
This might not be another of your "What Ever's" would it? How are we suppose to believe anything that passes your lips?

Thank you. There are those out there who have the ability to have picked up this up as soon as he said it. I was still getting over the fact he was up there at all. But afterwards, it started bugging me.
BTW - Though it was pointed out that Jack is not part of the PB because he is no longer on the BOS, I saw him having a little conference with Sue Killam before he spoke. Maybe not on the board, but the ties are still there.
Once again, the self-appointed know-it-all from Danville, Curt Springer, has intruded himself into Atkinson's political and voting issues.
Before every one of our regular or special town meetings, Springer butts into Atkinson's business and tries to influence, manipulate/tell Atkinson's voters how to vote concerning its water issues. And at each Atkinson town meeting, Atkinson voters "give him the bird" and resoundingly repudiate him and his butt-in-ski tactics.
When is this guy going to learn that Atkinson residents don't like him trying to constantly interfere in Atkinson matters which are none of his business?
Plaistow residents feel the same way about his also trying to always intrude himself into Plaistow's business, telling them how to run their lives. He's been banned from their blog.
Having already been repudiated by the people of Danville, he now continues to try to leech himself into our business.
Springer, get a life of your own that does'nt involve Atkinson and Atkinson's business.
